Ghostfile Platform Terms of Use

Effective as of: 1 January 2026

1. General Provisions

These Terms set out the fundamental rights and obligations of the Provider and Visitors (as defined below).

The Provider operates the Ghostfile platform, through which it offers the use of the Application not only in the Czech Republic but also in other countries, in accordance with the current offerings on the Portal (as defined below).

For the purposes of these Terms, the following definitions shall apply:

  • "Application" means the Ghostfile digital legacy management application that allows users to securely store and organize personal information, documents, media, and messages to be accessed by designated beneficiaries after the user's death. The App provides tools to create a "vault" of digital assets and designate a "Circle of Trust" of trusted individuals who can access this vault when needed;
  • "Visitor" means any natural or legal person who accesses the Portal;
  • "Civil Code" means Czech Act No. 89/2012 Coll., the Civil Code, as amended;
  • "Terms" means these terms of use of the Portal;
  • "Portal" means the web platform operated by the Provider at https://www.ghostfileapp.com/;
  • "Provider" means Filip Haškovec, identification number 01055763, with his registered office at Dělnická 313/14, 170 00, Prague 7 – Holešovice, the Czech Republic;
  • "Service" means a service or bundle of services provided by the Provider consisting of the granting of a licence to use the Application, and, where applicable, the provision of other related services as per the Provider's current service offering on the Portal;

2. General Terms of Use of the Portal

By accessing or otherwise using the Portal, you become a Visitor. Visitors are required to familiarise themselves with these Terms.

By accessing or using the Portal, you, as a Visitor, agree to these Terms and undertake to comply with the rules set out herein, including all rules and additional terms referenced by these Terms. If you do not agree to these Terms, you are not authorised to use the Portal.

The Provider is the owner of the Portal as a copyrighted work and exercises all proprietary rights relating to the Portal and its content, or is otherwise authorised to use it.

The content of the Portal may not be stored, modified, distributed, or otherwise exploited unless the Provider has given prior written consent for such actions.

The Provider makes available to Visitors a range of Services on the Portal. Prices listed in the Service offering are not legally binding and may be subject to change.

The publication of a Service offering on the Portal does not entitle the Visitor to any performance. The Visitor acknowledges that information provided on the Portal is for informational purposes only.

3. Rights and Obligations of the Provider and the Visitor

The Visitor is obliged, when using the Portal and Services, to comply with generally binding legal regulations and to respect the rights of the Provider and third parties. In particular, the Visitor must not:

  • use the Portal or Services in contravention of these Terms;
  • use the Portal or Services in a manner likely to cause harm to the Provider, other Visitors, and/or third parties;
  • copy the Portal or any part thereof, modify the content of the Portal or any part thereof, or otherwise interfere with, threaten, or disrupt its operation;
  • use mechanisms, software, or other procedures that could adversely affect the operation of the Portal, including mass data collection from the Portal.

The Visitor is liable for any direct or indirect loss or damage caused by their actions (or omissions) in breach of these Terms or generally binding legal regulations.

The Provider processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR). Details of how personal data is collected, used, stored, and protected are set out in the Provider's Privacy Policy. By using the Portal, the Visitor consents to such processing and warrants that all data provided is accurate.

All intellectual property rights in the Portal, its content, and the Services (including but not limited to text, graphics, logos, images, software, and digital materials) are owned by or licensed to the Provider. Except as expressly permitted under these Terms, no part of the Portal or its content may be reproduced, distributed, or otherwise exploited without the Provider's prior written consent.

The Portal is intended for use by individuals who are at least 16 years old. Where users are under 16, use of the Portal and Services must be supervised by a parent or legal guardian, who shall be responsible for compliance with these Terms.

4. Provider's Liability for Portal Operation

To the fullest extent permitted by applicable law, the Visitor hereby expressly waives any and all rights to claim compensation for any loss, damage, or injury (including, without limitation, direct, indirect, incidental, consequential, special, exemplary, or future damages, and including loss of profit, loss of data, loss of goodwill, or any other intangible losses) arising out of or in connection with the use of, or inability to use, the Portal or the Services, or any reliance placed on the information or content provided therein, regardless of the cause and regardless of whether such damages were foreseeable or whether the Provider was advised of the possibility of such damages.

The Provider shall not be liable to the Visitor for any loss or damage of any kind, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, except to the extent that such liability cannot be lawfully excluded or limited under the mandatory provisions of Czech law.

Nothing in these Terms shall operate to exclude or limit the Provider's liability where such exclusion or limitation is prohibited by applicable law.

5. Final Provisions

The Provider reserves the right to terminate the operation of the Portal at any time and without compensation.

Matters not expressly regulated by these Terms, unless otherwise agreed by the parties, shall be governed by the Civil Code (as defined above) and other generally binding legal regulations.

The Provider reserves the right to modify the Portal, its scope, and functionality at any time and in any manner.

The Provider reserves the right to unilaterally amend or supplement these Terms at any time. Amendments to the Terms become effective upon their publication on the Portal (unless a later date is specified).

All contracts and documents relating to the use of the Portal and Services are archived by the Provider in electronic form and are not publicly accessible.

All legal relationships arising from or in connection with the Portal or Services and their use shall be governed by the laws of the Czech Republic, regardless of the location from which the Portal is accessed or used, or the country in which the Services are provided.

The Visitor acknowledges and agrees that the rights and obligations associated with the Portal and/or Services under these Terms may be assigned to third parties in accordance with generally binding legal regulations. The assignment or transfer of the Provider's rights and obligations shall not affect the validity and effectiveness of these Terms.

These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior agreements or understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Should any provision of these Terms become invalid, ineffective, or unenforceable, such provision shall be replaced by a provision whose meaning most closely approximates the invalid provision. The invalidity or ineffectiveness of any provision shall not affect the validity and effectiveness of the remaining provisions.
